Hereinafter referred to as "Zultem" or "the Operator", a designation that remains valid regardless of the legal form of the entity at any given time, including in the event of the future incorporation of a company.
2. Purpose
This Legal Notice governs general access to and use of the website zultem.com as an information and e-commerce platform, and is complementary to the Terms and Conditions, which specifically govern the purchase and sale of products, and to the Privacy Policy and Cookie Policy, which govern the processing of personal data and cookies.
3. Hosting
The Store is operated on the technological infrastructure provided by Shopify Inc. and its affiliated entities (including, for customers in the European Union, Shopify International Limited), an e-commerce and hosting service provider that makes available the technical platform used by Zultem to operate zultem.com and account.zultem.com. Additional information on Shopify's role in the processing of personal data is set out in the Privacy Policy.
The identification of Zultem as the economic operator responsible for the products made available in the Store, for product safety purposes, is set out in detail in the Terms and Conditions.
4. Intellectual and Industrial Property
4.1 Ownership. The "Zultem" trademark, its logo, the design of the Store, and the texts, images, graphics and other content made available therein are the property of Zultem or its licensors and are protected under applicable intellectual and industrial property legislation, namely the Portuguese Copyright and Related Rights Code and the Portuguese Industrial Property Code.
4.2 Prohibited use. The reproduction, distribution, public communication, transformation or any other form of exploitation of this content without the prior express authorization of Zultem is prohibited, with the exception of strictly personal and non-commercial use inherent to normal browsing of the Store. This prohibition covers, in particular:
- The automated extraction of content from the website (scraping) through scripts, bots or other automated tools, without the prior authorization of Zultem;
- The use of Store content to train, feed or operate artificial intelligence systems, including text or image generation models, without the prior authorization of Zultem. This reservation is made under and for the purposes of Article 4 of Directive (EU) 2019/790 (Directive on Copyright in the Digital Single Market), which allows rightholders to expressly reserve, through appropriate means, the use of their works for the purposes of text and data mining;
- The massive and systematic copying, republication or reuse of Store content, even where each individual use, taken in isolation, might be considered of minor relevance.
This reservation of rights is communicated, for technical purposes, through the website's robots.txt file and other machine-readable instructions that Zultem may adopt, and it is this mechanism that determines, at any given time, which automated access is authorized. Indexing and access carried out by search engines and other tools widely recognized as legitimate for the purposes of discovering publicly available content on the internet are excluded from the above prohibition, to the extent that they comply with such technical instructions.
4.3 Reporting infringements. Any person who considers that content made available in the Store infringes their intellectual property rights may report the situation to Zultem through the contacts indicated in the Contact Information, providing sufficient identification of the content in question, the right allegedly infringed, and the elements enabling Zultem to assess the complaint. Zultem will review the report in good faith and, if the infringement is confirmed, will remove or correct the content in question within a reasonable period, and may request additional clarification from the reporting party whenever the information provided is insufficient for a well-founded assessment.
5. General Conditions of Use of the Website
Access to zultem.com is, as a rule, free of charge, without prejudice to the cost of the internet connection borne by the user. Use of the website must comply with applicable law, good faith, public policy and these terms, and the user is prohibited from:
- Using the website for unlawful, fraudulent purposes or purposes that infringe the rights of third parties;
- Introducing or spreading computer viruses or any other system capable of damaging the website or third-party systems;
- Attempting to access restricted areas of the website without authorization;
- Using automated data extraction mechanisms (scraping) or mass access to the website without the prior authorization of Zultem, pursuant to section 4.2.
6. Links to Third-Party Websites
The website may contain links to third-party websites, provided for convenience. Zultem does not control and is not responsible for the content, privacy policies or practices of such third-party websites, and users are advised to read the respective terms before using them.
7. Availability of the Website
Zultem makes reasonable efforts to ensure the normal operation of the website, but cannot guarantee its uninterrupted or error-free availability, namely in situations of maintenance, updates, or causes beyond its reasonable control, including failures attributable to technological infrastructure providers.
8. Limitation of Liability
Without prejudice to the provisions of the Terms and Conditions regarding contractual liability for the sale of products, Zultem shall not be liable for damages arising from:
- The temporary unavailability or interruption of the website;
- The improper use of the website by third parties;
- Content of third-party websites accessible through links made available on the website;
except in cases where such limitation is not legally permissible.
9. Minors
Access to and use of the website by minors must be carried out under the supervision and with the authorization of their legal representative, as also provided for in the Privacy Policy.
10. Applicable Law
This Legal Notice is governed by Portuguese law, without prejudice to the protection afforded to consumers residing in other European Union Member States under the terms referred to in the Terms and Conditions.
